The FPTA Annual Conference will be held September 18-20, 2022 at the Naples Grande Beach Resort in Naples, Florida.
By completing the registration process and providing payment, you agree to these terms and conditions.
Exhibitor Contract Rules & Regulations
ELIGIBLE EXHIBITS
Florida Public Transportation Association (FPTA) reserves the right to decline any application for rental of exhibit space if, in its sole discretion, it determines that the company or its products or services are not compatible with and/or complementary to the mission of Florida Public Transportation Association or the Annual Conference, including, but not limited to, a company whose programs, products, and/or services compete with FPTA’s programs, products and/or services.
EXHIBIT SPECIFICATIONS
All exhibits are tabletop style. All exposed parts of a display must be finished so as not to be objectionable to other exhibitors or attendees. Boxes and other packing materials must fit underneath the skirted exhibit table. No walls, partitions, decorations, hanging or free-standing items, or other obstructions may be erected that in any way interfere with the view of another exhibitor. The aisles must be free for all attendees and exhibitors.
INSTALLATION AND DISMANTLE
All displays must be installed before, occupied during, and dismantled in accordance with the schedule provided by FPTA. If the exhibitor is not set up by the time specified, FPTA reserves the right to re-assign the allocated space to another applicant or to make other use of the space as it deems appropriate, in its sole discretion.
NON-CONTRACTED SPACE
Apart from the specific display space for which an exhibitor has contracted, no part of the facility may be used by any person or organization other than FPTA for display purposes of any kind or nature. Persons, companies or organizations that have not contracted exhibit space may not engage in any type of selling, display or advertisement of products or services.
EVICTION AND RESTRICTION
FPTA reserves the right to restrict or evict exhibits, that because of noise, methods of operations, materials, or any other reason become objectionable; and also to prohibit or evict any exhibit which, in the opinion of FPTA, may detract from the general characteristics of the exhibition as a whole. In the event of such restriction or eviction, FPTA is not liable for any refunds of rentals or other exhibit expenses.
FOOD AND BEVERAGE
Exhibitors must adhere to the Naples Grande Beach Resorts concession and/or catering policy. This requires sales and serving of all foods and beverages for consumption on or off the premises, to be coordinated with the catering department. Example: Offering complimentary alcoholic beverages at an exhibit display. At its sole discretion, FPTA may withhold or withdraw permission to allow food and beverage items.
FIRE PROTECTION
Exhibitors are required to comply with all local fire regulations. Exhibit decorations must be flame-proofed, and all hangings must clear the floor. Electrical wiring must comply with all federal, state and municipal government requirements. If inspection indicates that an exhibitor has neglected to comply with these regulations, or otherwise incurs fire hazards, FPTA reserves the right to cancel all or such part of the exhibit as may be non-compliant.
SECURITY / LOSS PREVENTION
FPTA and the exhibit facility are not responsible for any loss or damage to exhibitor property. Whether or not such security is provided, the exhibitor shall be solely responsible for the protection of its property and its confidential and proprietary information, and for obtaining insurance with respect thereto.
USE OF LOGOS
The logo of FPTA is the exclusive property of FPTA. The logo of FPTA may not be used in any way, i.e., promotional literature, giveaways, invitations or for any other purpose without written authorization from FPTA.
PHOTO / VIDEO RELEASE
FPTA occasionally uses photographs or videos of the Annual Conference, including the exhibitors, in promotional materials. The exhibitor grants to FPTA nonexclusive and worldwide license to use, store, reproduce, publish, distribute and display the exhibitor’s image, branding, marketing materials, trademarks, and other materials use or displayed at the Annual Conference.
INDEMNITY
The exhibitor assumes entire responsibility and hereby agrees to protect, indemnify, defend, and save FPTA and Naples Grande Beach Resort, and their officers, employees, and agents, harmless against all claims, losses and damages to persons, property, governmental charges of fines and attorney’s fees arising out of, or caused by exhibitor’s installation, removal, maintenance, occupancy, or use of the exhibiting premises or a part thereof, excluding such liability caused by the sole negligence of the parties referred to above. In addition, the exhibitor acknowledges that FPTA and Naples Grande Beach Resort do not maintain insurance covering the exhibitor’s property and that it is the sole responsibility of the exhibitor to obtain business interruption and property damage insurance covering such losses by the exhibitor.
FORCE MAJEURE AND IMPOSSIBILITY
FPTA shall not be responsible for any loss or damage resulting from failure to perform under this contract or to conduct this event as currently scheduled in whole or part. The performance of this contract by FPTA is subject to termination without liability, upon the occurrence, or as a result of, any riot, strike, labor dispute, acts, regulations or orders of governmental authorities, civil disorder, act of war, act of terrorism, failure of facilities, earthquake, storm, fire, flood, pandemic (including the novel coronavirus (“COVID-19”), epidemic, disease, or other acts of God, or any reason of any kind whatsoever beyond the reasonable control of FPTA. Notwithstanding any other terms of this contract, if this event is cancelled by FPTA and not rescheduled in connection with a force majeure event, FPTA’s sole liability to the exhibitor, and exhibitor’s exclusive remedy, shall be a refund of the fees for this event paid by exhibitor under this contract less a pro rata rate adjustment based on costs incurred by FPTA in connection with this cancelled event.
OTHER RULES AND REGULATIONS
The exhibitor shall comply with all applicable laws, rules, regulations, ordinances, codes and statutes with respect to the conduct of its exhibit. The exhibitor shall also comply with the exhibitor manual, if provided by FPTA, and all reasonable requests of FPTA and the Naples Grande Beach Resort with respect to the conduct of its exhibit. FPTA and the Naples Grande Beach Resort may issue further rules and regulations governing the event or use of the facilities from time to time. The exhibitor agrees to abide by all such rules and regulations, to the extent reasonable.
INTERPRETATION AND AMENDMENT
Florida Public Transportation Association (FPTA) has the full power to interpret or amend any of the exhibition rules and its decision is final. The exhibitor agrees to abide by any rules or regulations set forth by FPTA and recognizes that FPTA is committed to providing full cooperation to ensure a successful show for all exhibitors.
